Terms and Conditions for TFM (E-commerce Platform) for purchasing from TFM

1. Introduction

Welcome to TFM (“we,” “our,” “us”). By accessing or using our website (the “Site”), you agree to comply with and be bound by these Terms and Conditions (the “Agreement”). If you do not agree to these terms, please refrain from using the Site.

TFM supplies Indian dry groceries, dairy, fresh vegetables, plastic containers, and frozen products for restaurants in Canada. These Terms and Conditions govern your use of the Site, purchases made, and any services provided by TFM.

2. Eligibility
You must be a business entity operating in Canada, such as a restaurant or food service provider, and legally able to enter into binding agreements.

3. Ordering and Payment
Order Acceptance: Orders placed on the Site are subject to our acceptance. TFM reserves the right to refuse or cancel orders at our discretion.
Pricing: All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes (e.g., HST, GST on eligible items). Prices may change without notice.
Payment: Payment must be made at checkout using accepted methods such as credit cards, e-transfers, or other methods specified on the Site. Orders are final upon payment processing unless eligible for a refund (see section 1.6).
Invoice Errors: In the event of an invoicing error, TFM reserves the right to adjust the invoice and notify the customer promptly.

4. Shipping and Delivery
Shipping Times: Delivery timelines are estimates and may vary based on location and product availability.
Third-Party Couriers: TFM utilizes third-party couriers and is not responsible for delivery delays beyond its control.
Customer Responsibility: Customers must inspect shipments upon delivery, particularly for perishable items. Claims for damaged or missing items must be reported within 48 hours.
TFM Responsibility: TFM ensures that all products are carefully packaged to preserve their quality and integrity, with special attention given to frozen and perishable items to maintain freshness and prevent spoilage during transit.

5. Product Availability and Quality
Accuracy Disclaimer: Product descriptions, prices, and availability are provided as accurately as possible but may be subject to change.
Out-of-Stock Items: If a product is unavailable after an order is placed, TFM will notify the customer, and the affected order may be canceled or delayed.

6. Returns and Refunds
Eligible Returns: Only products that are defective, damaged, or incorrect are eligible for return. Perishable items (e.g., dairy, frozen products) cannot be returned. Return Process: Claims must be made within 48 hours of delivery by contacting customer service.
Refunds: Approved refunds will be issued to the original payment method.

7. Privacy and Data Protection
TFM complies with the Personal Information Protection and Electronic Documents Act (PIPEDA). Personal data will be collected, used, and stored as outlined in our Privacy Policy.

This Agreement is governed by the laws of the Province of Ontario, Canada. Disputes will be resolved through binding arbitration in Toronto, Ontario. Exceptions apply to intellectual property or statutory violations.

11. Amendments
TFM reserves the right to update these Terms and Conditions. Changes will be posted on the Site and effective upon posting. Continued use of the Site signifies acceptance.
